OUR SERVICES
Photo Adventure Workshops LLC, hereby referred to as PAW, provides photo tours, multi-day workshops, both regional and international, photography education, both in-store and one-on-one educational experiences, and other Services. Together, these are hereby referred to as "Services".
CANCELLATION POLICY
We do understand that somethings in life are unexpected! If you must cancel a reservation with Photo Adventure Workshops LLC (PAW) / Yellowstone Camera LLC / Perfect Light Camera LLC - please contact us as soon as possible.
We highly encourage all participants to obtain Travel Insurance immediately after booking your workshop with us!
Protect Your Trip
Travel insurance isn’t just for medical assistance. There are several plans available to protect both you AND your belongings. This is the best plan of action for coverage for lost, damaged and stolen luggage and belongings. It is also wise to include coverage that replaces lost prescriptions and travel documents while you’re on your journey. It is also possible to cover your trip in the event that you need to cancel.
Workshop Fees All travel workshop balances are due 120 business days before workshop start date. Full payment is required on bookings taken 60 days prior to workshop start date. All workshop fees can be paid by check made out to “Perfect Light”. All card transactions for final payments will be charged a 3.5% processing fee. There will be a fee affixed for late payments.
Deposits are due at time of registration and are non-refundable.
Currently, all payments for workshops are non-refundable, including the deposit.
In the event that Perfect Light / Photo Adventure Workshops / Yellowstone Camera cancels a trip - then all refunds will be made by check (or can be transferred to a future workshop).
Cancellation Fees
Transfers: You may transfer your workshop registration to another person to participate in your place. To transfer, please submit written notifications of the alternate participant's name, email address, phone number, and mailing address via letter or e-mail to perfectlightcamera@gmail.com. You will be responsible for any transfer fees.
Safety, Insurance, and Physical Fitness: Every effort is made to ensure your safety. However, participants are responsible for their own safety and accident insurance. We do not accept responsibility for lost, stolen, or damaged property. Participants must be in good physical condition for activities in an environment that may be cold, wet, and windy.
If you are not present at time of trip departure, we will try our best to contact you. We cannot offer any refunds for no-shows.
Photo Adventure Workshops LLC (PAW) cannot offer partial refunds for unused Services. If you have to cut your trip short, no refunds will be given.
Rules and Regulations: Whether the workshop you participate in is held on private, public, or government lands, you agree to abide by all rules, restrictions, and ordinances governing such lands and property. You also agree to respect the rights of other workshop participants, instructors, and those providing services to or for the workshop. Failure to comply with any governing rules or authority may result in the removal of the participant from workshop photo tour or related activity with no provisions for refund.
Disputes and Jurisdiction: Any dispute over this contract involving litigation or court proceedings will be held to the governing laws of Bonneville County in the state of Idaho. Jurisdiction for any legal dispute over this contract will be conducted in the courts of Bonneville County in the state of Idaho.
Schedules: All workshop schedules are tentative (subjects, events, and times). Itineraries are subject to change without prior notice due to weather and other environmental conditions, direct or indirect logistical arrangements, transportation plans, health conditions of workshop participants and/or instructors, employees, or assigns, and/or any other factors deemed to be relevant by Photo Adventure Worskhops LLC / Perfect Light Camera LLC / Yellowstone Camera LLC - Workshops. However, we will make every effort to include just as many photographic and instructional opportunities to the participants if changes are made.
Model Release: You consent that any and all photographs made of you or that include you or your property may be used by Perfect Light Workshops and/or its assigns in promotional and/or advertising efforts for no fee and/or compensation.
Equipment: It is the responsibility of each participant to bring and provide his or her own equipment. Workshop participants will be given a list of suggested items to bring, but it is a suggested list only and does not replace personal preferences and for one’s possibly limited resources or health restrictions. We will attempt to have camera and accessory manufacturer’s demo products on hand for workshop participants to try and use. However, we make no promises as to the availability of any demo equipment.
TRIP CANCELLATION
In the event that a trip must be cancelled, due to guide sickness, accident of death, and passage of law and any action taken by a governmental or public authority, PAW will refund all fees paid minus non-refundable fees paid to the third party. In the unfortunate event that this occurs, PAW will contact all trip participants as soon as possible. PAW is not responsible for personal travel expenses to the gateway location or any other expenses incurred in preparation for the trip. For this reason we strongly suggest that you purchase Travel Insurance (and do so immediately after booking with PAW / Perfect Light Camera LLC / Yellowstone Camera LLC).
TRIP INSURANCE
Photo Adventure Workshops (PAW) / Yellowstone Camera LLC / Perfect Light Camera LLC - carries the necessary permits and liability insurance for legal operation of Services. It is the participants responsibility to carry adequate health and injury insurance for the locations we will be visiting. Photo Adventure Workshops (PAW) / Yellowstone Camera LLC / Perfect Light Camera LLC are not responsible for any health or injury liability.
HEALTH & PHYSICAL FITNESS
As each workshop presents a varied level of physical demand, PAW will be identifying each tour and workshop with a Physical Difficulty Rating. It is the participants responsibility to warrant they have adequate fitness for their intended tour/workshop.
DOUBLE OCCUPANCY
Some workshops will offer prices at double or single occupancy prices (often referred to as a Single Supplement). If booking as a single traveler, double occupancy cannot be guaranteed. If PAW is able to find another participant of the same gender, willing to share double occupancy, we will do our best to pair both participants. If PAW is unable to find a second traveler willing to share double occupancy, then you may be asked to either pay the Single Supplement (determined per trip) or pay the full amount for the room/cabin that would be covered by double occupancy).
CODE OF CONDUCT
Each participant shall conduct themselves in a civil manner to each of the instructors present as well as each of the other participants. There will be zero tolerance for rude or aggressive behavior. It is our goal to treat one another with respect and dignity and that is required and expected of all of our participants.
Any illegal activity, drunkenness, illegal drug use, poor treatment of other participants or staff members, disrespectfulness will not be tolerated. I will offer one warning before you will be asked to leave the group without any refund whatsoever and it will be your sole responsibility both physically and financially to make arrangements to leave the group immediately. PAW reserves the right to send participants home at their own expense if they are unwilling to comply with these expectations.
These photo workshops and tours are intended to be enjoyable to all. Please act accordingly, thank you very much.
Also, in a climate of political unrest, we ask that regardless of your political standing, you refrain from imposing your views related to politics during these workshops. We do not want differences in views of politics to divide or create unnecessary tension during these workshops. Thank you for your understanding.
RELEASE OF PHOTO/VIDEO RIGHTS
Model Release: You consent that any and all photographs made of you or that include you or your property may be used by Photo Adventure Workshops LLC (PAW) / Perfect Light Camera LLC / Yellowstone Camera Workshops and/or its assigns in promotional and/or advertising efforts for no fee and/or compensation.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Photo Adventure Workshops LLC, Perfect light Camera LLC, or Yellowstone Camera LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. To the maximum extent permitted by applicable law, Photo Adventure Workshops LLC, Perfect light Camera LLC, or Yellowstone Camera LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Without limitation, Photo Adventure Workshops LLC, Perfect light Camera LLC, or Yellowstone Camera LLC is not responsible to any person or damage to property arising out of negligent acts or omissions of itself or of any persons for whom it would otherwise be responsible, or acts which are beyond its control, including but not limited to acts of God or force majeure, inclement weather, weather emergencies, availability of emergency evacuation, epidemics, breakdown or failure of mechanical equipment, government actions, sickness, medical care or the adequacy of the same, sanitary conditions, quality or sanitation of food, attacks by animals, criminal activity of any kind, civil disturbance, terrorism, war, customs, regulations, strikes, travel provider overbooking, safety and/or security standards at hotels, accommodations or otherwise, any problems or injuries whatsoever arising from hiking or for any other reason beyond the control of Photo Adventure Workshops LLC, Perfect light Camera LLC, or Yellowstone Camera LLC . The participant is solely responsible for any costs for medical evacuation, use of aircraft, or other planned expense.
ARBITRATION
Any controversy or claim arising out of or relating to this Agreement or the performance thereunder, including without limitation any claim related to bodily injury, property damage or death, shall be settled by binding arbitration in Bonneville County, Idaho, USA in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. This Agreement to arbitrate does not waive or modify the liability release contained in this document. The dispute will be resolved by a single arbitrator who must be a lawyer admitted to practice in the courts of at least one state in the United States. The arbitrator so described will be selected by the American Arbitration Association. Each party to the dispute shall have the right to veto one arbitrator. There will be judicial review of the arbitrator's decision if either side can show plain error in the application of law or be able to show an abuse of discretion with respect to factual findings. The parties waive the right to rely on any state law or statute which creates an exception to enforcement of the requirement that disputes be resolved pursuant to arbitration in the manner set forth herein.
WAIVER OF JURY TRIAL
In connection with any action or legal proceeding arising out of this Agreement, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.
ACKNOWLEDGEMENT OF RISK
The participant in any PAW Photo Tour or Workshop understands and acknowledges that your participation and travel in an organized tour by PAW may involve risk and potential exposure to injury and possibly death. You also realize and acknowledge that risks and dangers may be caused by the negligence, fault and wrongdoing of the owners, employees, contractors of PAW or other participants, contractors and/or subcontractors to PAW. Risk and dangers may arise from foreseeable and unforeseeable causes. The participant full understands and acknowledges that the aforementioned risks, dangers and hazards are a potential in connection with your tour or workshop.
EXPRESS ASSUMPTION OF RISK
In recognition of the inherent risks associated with travel and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in this photo tour, that you are willingly and knowingly electing to participate in this workshop in spite of potential risk of danger, and you knowingly, willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether expected or not, of the owners, employees, contractors, or subcontractors of PAW or of other participants.
You understand and acknowledge that PAW reserves the right to accept or reject any participant for any legal reason, and PAW or its guide has the right to disqualify you from any trip activity, if in PAW's judgment, your continued participation in the tour will endanger yourself or the safety of the group.
RELEASE OF LIABILITY
On behalf of myself and my personal representatives, heirs, executors, administrators, agents and assigns, I hereby release and discharge in advance Perfect Light Camera LLC, Yellowstone Camera LLC, Photo Adventure
Workshops LLC. and it’s owners, employees, instructors, agents, representatives and assigns) from any and all liability, even if that liability arises out of negligence on the part of the persons or entities mentioned above.
ACKNOWLEDGEMENT
I have carefully read this Assumption of Risk, Waiver and Release of Liability, including Negligence. I am aware that both predictable and unpredictable risks are involved during the classes, workshops, tours and field outings conducted on behalf of PAW Photo Adventure Workshops LLC, Perfect Light Camera LLC, and/or Yellowstone Camera LLC, its owners, employees, affiliates, and agents.
I hereby agree to assume all of those risks and to release and hold harmless all of the persons or entities mentioned above who through negligence or carelessness would otherwise be liable to me or to my heirs or assigns for damages.
